e) Profiling

Profiling is any form of automated processing of personal data consisting of using that personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

f) Pseudonymisation

Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.

g) Controller or processor

The controller or data controller is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

h) Processors

A processor is a natural or legal person, public authority, agency or other body that processes personal data on behalf of the controller.

i) Recipient

Recipient means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.

j) Third party

A third party is a natural or legal person, public authority, agency or other body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

k) Consent

Consent is any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

4. Collection of general data and information

The Coaching Center Berlin OHG website collects a range of general data and information each time the website is accessed by a data subject or an automated system. The following may be recorded: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrer), (4) the sub-websites that are accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet Protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) other similar data and information that serves to avert danger in the event of attacks on our information technology systems.

5. Registration on our website

Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller’s database.

The controller shall provide any data subject with information on the personal data stored about them at any time upon request. Furthermore, the controller shall correct or delete personal data at the request or upon notification of the data subject, provided that this does not conflict with any statutory retention obligations. All employees of the controller are available to the data subject as contact persons in this regard.

6. Subscription to our newsletter

On the website of Coaching Center Berlin OHG, users are given the opportunity to subscribe to our company’s newsletter. The personal data transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose.

Coaching Center Berlin OHG informs its customers and business partners at regular intervals about the company’s offers by means of a newsletter. The newsletter of our company can only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter. Furthermore, subscribers to the newsletter may be informed by e-mail if this is necessary for the operation of the newsletter service or for registration, as may be the case in the event of changes to the newsletter offer or changes to the technical conditions. 7. Newsletter tracking

The newsletters from Coaching Center Berlin OHG contain so-called tracking pixels. 11. Routine deletion and blocking of personal data

a) Right to confirmation

Every data subject has the right granted by European directives and regulations to request confirmation from the controller as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right of confirmation, they may contact an employee of the controller at any time.

b) Right to information

Every person affected by the processing of personal data has the right, granted by European directives and regulations, to obtain from the controller, at any time and free of charge, information about the personal data stored about them and a copy of this information. Furthermore, European directives and regulations grant the data subject the right to obtain the following information:

– the processing purposes
– the categories of personal data that are processed
– the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
– the existence of a right to rectification or erasure of personal data concerning them or to restriction of processing by the controller or a right to object to such processing
– the existence of a right of appeal to a supervisory authority
if the personal data is not collected from the data subject: all available information about the origin of the data
– the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject
Furthermore, the data subject has the right to obtain information about whether personal data has been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards in connection with the transfer.

c) Right to rectification

Every person affected by the processing of personal data has the right granted by European directives and regulations to request the immediate correction of inaccurate personal data concerning them. Furthermore, the person concerned has the right to request the completion of incomplete personal data, taking into account the purposes of the processing, including by means of a supplementary statement.

If a data subject wishes to exercise this right of rectification, they may contact an employee of the controller at any time.

d) Right to erasure (right to be forgotten)

Any person affected by the processing of personal data has the right granted by European directives and regulations to request that the controller delete personal data concerning them without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:

The personal data has been collected or otherwise processed for purposes for which it is no longer necessary.
The data subject withdraws their consent on which the processing was based in accordance with Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, and there is no other legal basis for the processing.
The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.
The personal data has been processed unlawfully.
The erasure of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.
The personal data has been collected in relation to information society services offered in accordance with Art. 8(1) GDPR.
If one of the above reasons applies and a data subject wishes to request the erasure of personal data stored by Coaching Center Berlin OHG, they may contact an employee of the controller at any time. The employee of Coaching Center Berlin OHG will ensure that the erasure request is complied with immediately.

If the personal data has been made public by Coaching Center Berlin OHG and our company is obliged to delete the personal data as the controller pursuant to Art. 17 (1) GDPR, Coaching Center Berlin OHG shall take appropriate measures, including technical measures, taking into account the available technology and implementation costs, to inform other controllers who process the published personal data that the data subject has requested these other data controllers to delete all links to this personal data or copies or replications of this personal data, unless processing is necessary. g) Right to object

If the decision (1) is necessary for the conclusion or performance of a contract between the data subject and the controller, or (2) it is based on the data subject’s explicit consent, the Coaching Center Berlin OHG shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

Each time one of the individual pages of this website, which is operated by the controller and on which a Facebook component (Facebook plug-in) has been integrated, is accessed, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. The purpose of the Google Analytics component is to analyze the flow of visitors to our website. Google Analytics places a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is enabled to analyze the use of our website. Each time one of the individual pages of this website, which is operated by the controller and on which a Google Analytics component has been integrated, is accessed, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis.
